| چکیده | ||
| شهرها چهره دوگانه دارند. تمدن، زیبایی ، صلح و نظم در برخی از آنها نمایان است؛ در برخی دیگر تبعیض، خشونت ، ستیز و نارضایتی نهادینه شده و شهرتا حد یک ندامتگاه بزرگ تنزل کرده است. حقوق ، به عنوان ابزار همزیستی و نظم بخشی ، در شکل گیری شهر عدالت محور و مقابله با شهر قانونگریز نقش بنیادین دارد و به یاری آن مسیر عبور از شهرهای آلوده، فقیر و خشن هموار می شود. ایران بدون بازاندیشی در شیوه حکمرانی شهری این گذرگاه هراسناک را پشت سر نخواهد گذاشت. حقوق شهرسازی نشانه زایش و نوگرایی در گستره حقوق عمومی است. رویش شاخه ای نوین از تنه کهن حقوق ایرانی نوید بخش و گواه مسئولیت پذیری جامعه حقوقی در برابر انحرافات گسترده شهرسازی و مدیریت شهری در عصر غلبه سود جویی های شخصی بر منافع همگانی است. این مقاله در پی شناساندن چیستی، موضوع، قلمرو، جایگاه و سودمند مندی حقوق شهرسازی به شیوه توصیفی - تحلیلی و محصول اندیشه ورزی در آثار برجسته اندیشمندان ایرانی و حقوقدانان فرانسوی و همچنین آرای پراهمیت دادرسان دادگاه ها و دیوان عدالت اداری است. نویسنده بر آن است تا با نقد و بررسی وضع موجود مسیر حقوقی رسیدن به وضع مطلوب را ترسیم نماید. | ||

| Cities have a dual face. Civilization, beauty, peace and order are evident in some of them; in others, discrimination, violence, conflict and dissatisfaction have become institutionalized and the city has degraded to the level of a large penitentiary. Law, as a tool for coexistence and regulation, plays a fundamental role in the formation of a justice-oriented city and confronting the lawless city, and with its help, the path through polluted, poor and violent cities is paved. Iran will not pass this terrifying passage without rethinking its urban governance method. Urban planning law is a sign of birth and modernization in the scope of public law. The growth of a new branch from the old trunk of Iranian law is promising and evidence of the responsibility of the legal community against the widespread deviations of urban planning and urban management in an era where personal profiteering prevails over public interests. This article seeks to introduce the essence, subject, scope, status, and usefulness of urban planning law in a descriptive-analytical manner and as a product of thought in the works of prominent Iranian thinkers and French jurists, as well as the important opinions of judges of the courts and the Administrative Court of Justice. The author aims to outline the legal path to achieving the desired state by criticizing and examining the current situation. | ||
