| چکیده | ||
| انسان بزرگترین دشمن انسان است؛ ستیزه جویی، جنگ و تجاوز، عمری به قدمت تاریخ دارد. شهرها نیز به عنوان اصلیترین و بزرگترین کانونهای زیست انسانی، هیچ گاه از آسیب جنگ مصون نبودهاند. در گذشته برای صیانت از شهرها، پیرامون آنها خندق حفر میشد، دیوارهای مستحکم و برجهای دیدهبانی بنا میگردید اما در جهان معاصر، تجاوز به شهرها صورتی پیچیدهتر، فناورانه تر و مخربتر یافته است. شهرها به خودی خود هدف نظامی به شمار نمی آیند، اما استقرار مراکز نظامی، پادگانها و زیرساختهای دفاعی در مجاورت آنها میتواند مخاطرات امنیتی شدیدی ایجاد کند. حقوق دانان و رسانه ها در باره حقوق بشر دوستانه، مسوولیت دولتها و جنایات جنگی به سبب حمله به تاسیسات و مناطق مسکونی فراوان سخن گفته اند لیکن اندیشه ورزی در باره تاثیرات جنگ و نزاع مسلحانه بر حقوق داخلی و به ویژه حقوق شهرسازی به قدر کفایت انجام نشده است. پرسش ها در این باره فراوان است: - آیا قانونگذار، در وضع قوانین شهرسازی و تاب آوری شهرها و ساختمان ها به هنگام جنگ، دوراندیش و خلاق بوده است ؟ - آیا شهرداران، سازمان نظام مهندسی و وزارت راه و شهرسازی در اجرای قوانین تضمیمن کننده امنیت و ایمنی شهرها و ساختمان ها عملکرد قابل قبولی داشته اند؟ - آیا جبران زیان های ناشی از ویرانی ساختمان ها و بازسازی آنها ضابطه مند و تضمین کننده حقوق زیان دیدگان می باشد؟ کاستی در قانونگذاری و اجرای آن دیده می شود. جان، سلامت و اموال شهروندان در شهر امن و ایمن ب | ||

| Man is the greatest enemy of man; hostility, war and aggression are as old as history. Cities, as the main and largest centers of human life, have never been immune to the damage of war. In the past, moats were dug around cities, strong walls and watchtowers were built to protect them, but in the contemporary world, aggression against cities has taken on a more complex, technological and destructive form. Cities themselves are not considered military targets, but the establishment of military centers, garrisons and defense infrastructures in their vicinity can create severe security risks. Lawyers and the media have spoken a lot about humanitarian rights, the responsibility of states and war crimes due to attacks on residential facilities and areas, but there has been insufficient reflection on the effects of war and armed conflict on domestic law, especially urban planning law. There are many questions about this: - Has the legislator been farsighted and creative in enacting urban planning laws and the resilience of cities and buildings during war? - Have the mayors, the Engineering System Organization, and the Ministry of Roads and Urban Development performed acceptable performance in implementing laws that guarantee the security and safety of cities and buildings? - Is compensation for losses resulting from the destruction of buildings and their reconstruction regulated and guarantees the rights of the victims? There are shortcomings in legislation and its implementation. | ||
