| جنگهای معاصر بهطور فزایندهای در محیطهای شهری رخ میدهد و میلیونها غیرنظامی پیامدهای فاجعهبار آن را تحمل میکنند. فضای شهری با تراکم بالای جمعیت و زیرساختهای حیاتی، ناقصترین بستر اجرایی قواعد بشردوستانه است. هدف: پژوهش حاضر در پی پاسخ به این پرسش است که چارچوب هنجاری حقوق مخاصمات مسلحانه تا چه میزان از حقوق بنیادین ساکنان شهرها حمایت میکند و دولتهای متخاصم چگونه در قبال نقض این حقوق مسئول میشوند. روش پژوهش: مقاله به شیوهی توصیفی _تحلیلی و با تکیه بر منابع حقوق بینالملل عمومی، حقوق بشردوستانه، اساسنامهی رم، رویهی قضایی، اسناد سازمان ملل و مطالعات تطبیقی در فقه اسلامی تدوین شده است. یافتهها: اصلیترین چالش نه کمبود قاعده، بلکه « عدم اجرا » و « خلأ ارادهی سیاسی » است. حملات عمدی به مناطق مسکونی، محاصرهی شهرها، تخریب میراث فرهنگی و نادیده گرفتن نیازهای زنان و کودکان، نقض گستردهی « حقوق شهری » (حق مسکن، سلامت، آب، آموزش، هویت فرهنگی) را سبب میشود. رویهی قضایی (پروندهی المهدی، آرای ICTY) گامهای اولیه برای شناسایی مسئولیت کیفری فرماندهان در تخریب بناهای تاریخی را نشان میدهد، اما حاکمیت خارجی دولتها (منافع ملی) و فقدان ضمانت اجرای مؤثر، مانعی جدی بر سر راه تحقق مسئولیت بینالمللی دولتها بهویژه در قالب جنایت علیه بشریت است. نتیجهگیری: تخریب سیستماتیک زیرساختهای شهری در چارچوب یک حملهی گسترده یا سیستماتیک و با آگاهی مرتکبان، میتواند جنایت علیه بشریت (مادهی ۷ اساسنامهی رم) باشد. | ||

| Contemporary wars are increasingly occurring in urban environments, where millions of civilians suffer their devastating consequences. The urban space, with its high population density and critical infrastructure, represents the most imperfect setting for the implementation of humanitarian law rules. Objective: This study seeks to answer the question of to what extent the normative framework of the law of armed conflict protects the fundamental rights of city dwellers, and how belligerent states are held accountable for violations of these rights. Methodology: This article employs a descriptive-analytical approach, drawing on sources from public international law, international humanitarian law, the Rome Statute, judicial practice, United Nations documents, and comparative studies in Islamic jurisprudence. Findings: The main challenge is not a lack of rules, but rather "non-enforcement" and a "void of political will." Deliberate attacks on residential areas, sieges of cities, destruction of cultural heritage, and disregard for the needs of women and children result in widespread violations of "urban rights" (the right to housing, health, water, education, and cultural identity). Judicial practice (the Al-Mahdi case, ICTY judgments) shows initial steps toward recognizing the criminal responsibility of commanders for the destruction of historical monuments. However, the external sovereignty of states (national interests) and the absence of effective enforcement mechanisms pose serious obstacles to the realization of international state responsibility, particularly in the form of crimes against humanity. Conclusion: The systematic destruction of urban infrastructure as part of a widespread or systematic attack, committed with knowledge of the perpetrators, may constitute a crime against humanity (Article 7 of the Rome Statute). | ||
