| چکیده هدف: حملات نظامی ایالات متحده آمریکا و اسرائیل علیه شهرهای ایران، با توجه به آثار آن بر صلح و امنیت بینالمللی، چالشهای حقوقی مهمی در زمینه مشروعیت توسل به زور، رعایت حقوق بینالملل بشردوستانه و مسئولیت بینالمللی دولتها ایجاد کرده است. این پژوهش با هدف بررسی وضعیت حقوقی این حملات و تبیین تعامل میان حقوق حاکم بر توسل به زور (Jus ad Bellum) و حقوق حاکم بر اداره مخاصمات مسلحانه (Jus in Bello) انجام شده است. روش: این پژوهش با روش توصیفی ـ تحلیلی و بر پایه مطالعات کتابخانهای انجام شده است. در این راستا، با بهرهگیری از منشور ملل متحد، کنوانسیونهای ژنو ۱۹۴۹، پروتکلهای الحاقی ۱۹۷۷، پیشنویس مواد مسئولیت دولتها و دیگر اسناد بین المللی برای اعمال متخلفانه بینالمللی، مشروعیت حملات نظامی علیه شهرهای ایران مورد ارزیابی قرار گرفته است. یافتهها: یافتههای پژوهش نشان میدهد که حتی در فرض احراز شرایط دفاع مشروع بر اساس ماده ۵۱ منشور ملل متحد، دولتها همچنان مکلف به رعایت کامل قواعد آمره حقوق بینالملل بشردوستانه هستند. حملات علیه شهرها، در صورت نقض اصول تفکیک، تناسب، احتیاط در حمله یا ضرورت نظامی، میتواند موجب تحقق مسئولیت بینالمللی دولتها شود. نتیجهگیری: مشروعیت حقوقی عملیات نظامی مستلزم احراز همزمان شرایط قانونی توسل به زور و رعایت کامل قواعد حقوق بینالملل بشردوستانه در جریان اجرای عملیات است و رعایت یکی از این دو نظام حقوقی، ناقض بودن رفتار در نظام دیگر را توجیه نمیکند. ازاینرو، نقض هر یک از این دو نظام، مبنایی مستقل برای انتساب مسئولیت بینالمللی به دولت متخلف محسوب میشود. | ||

| Legal Analysis of the United States and Israel's Military Attacks on Iranian Cities in the Light of Contemporary International Law | ||

| Abstract Objective: The military attacks carried out by the United States and Israel against Iranian cities have generated significant legal challenges concerning the legality of the use of force, compliance with international humanitarian law (IHL), and the international responsibility of states. Given their implications for international peace and security, the protection of civilians, and regional stability, these attacks require an integrated legal assessment. This study examines their legal status under contemporary international law by analysing the relationship between the law governing the resort to force (jus ad bellum) and the law governing the conduct of hostilities (jus in bello). Method: This study employs a descriptive-analytical methodology based on documentary and library research. It examines the legal issues in light of the Charter of the United Nations, the 1949 Geneva Conventions, the 1977 Additional Protocols, customary international law, the jurisprudence of the International Court of Justice, the documents of the International Committee of the Red Cross, and the International Law Commission's Draft Articles on Responsibility of States for Internationally Wrongful Acts. Findings: The findings demonstrate that even where the use of force may prima facie satisfy the legal requirements of self-defence under Article 51 of the United Nations Charter, such justification does not exempt states from strict compliance with international humanitarian law. Military operations directed against cities, critical infrastructure, medical facilities, cultural property, and other civilian objects, where conducted in violation of the principles of distinction, proportionality, precautions in attack, or military necessity, may give rise to the international responsibility of states and, where the legal requirements are met, the individual criminal responsibility of those responsible. Conclusion: The legality of military operations depends upon the cumulative fulfilment of the requirements governing both jus ad bellum and jus in bello. Compliance with one legal regime cannot justify violations of the other. Accordingly, any breach of either regime constitutes an independent legal basis for the attribution of international responsibility to the offending state. The originality of this study lies in providing an integrated legal analysis of the interaction between these two branches of international law in assessing military attacks against Iranian cities and clarifying their implications for the international responsibility of states. | ||
