| چکیده: قرارادادهای هوشمند امروزه به نحو گسترده ای در صنایع مختلف مورد استفاده قرار گرفتهاند. برخی ویژگیهای خاص قراردادهای هوشمند همچون اجرای خودکار و انعقاد در بستر بلاکچین، این قراردادها را تا حدی از قراردادهای سنتی متمایز میگرداند. در حوزه حقوق مصرف شاهد استفاده گسترده ای از قراردادهای هوشمند هستیم، این شیوع این سوال را مطرح میکند که قواعد سنتی و قواعد مربوط به حمایت از مصرف کننده در قراردادهای سنتی و قراردادهای الکترونیکی تا چیه میزان در مورد قراردادای هوشمند نیز جریان مییابند و آیا در این زمینه نیاز به تدوین قواعد خاصی نیز هست؟ لذا چالش اصلی پژوهش حاضر بررسی ماهیت قراردادهای هوشمند در حوزه حقوق مصرف و چارچوب حمایت از مصرف کننده در این قراردادها است. در انتها مشخص خواهد شد که که قراردادهای هوشمند منعقد شده بر بستر بلاکچین دارای ماهیت جدیدی نیستند و همان قراردادهای سنتی هستند که بر بستر بلاکچین منعقد شده اند؛ اما وجود برخی ویژگیها همچون اجرای خودکار و همچنین شیوه خاص انعقاد آنها نیاز به برخی قواعد حمایتی خاص از مصرف کنندگان را توجیه مینماید. | ||

| Abstract:Smart contracts are widely utilized across various industries today. Certain unique features of smart contracts, such as automated execution and formation on the blockchain, distinguish them to some extent from traditional contracts. In the field of consumer law, there is a growing prevalence of smart contracts, raising the question of the extent to which traditional legal principles and consumer protection regulations applicable to conventional and electronic contracts also apply to smart contracts. Additionally, it remains to be determined whether specific legal frameworks need to be developed for this emerging phenomenon. Thus, the primary challenge of this study is to examine the nature of smart contracts within the domain of consumer law and the framework for consumer protection in such contracts. Ultimately, it will be demonstrated that smart contracts executed on the blockchain do not possess a fundamentally novel legal nature; rather, they are traditional contracts implemented through a blockchain infrastructure. However, certain characteristics, such as automated execution and the specific manner of their formation, justify the necessity of tailored protective regulations for consumers. | ||
