| چکیده | ||

| چکیده [English] | ||
| Structural centralization in Iran's administrative system has always been a fundamental obstacle to the fair redistribution of territorial opportunities and the realization of spatial justice.The dominance of technocratic and authoritative approaches in land use planning has confronted regional development with challenges of inefficiency and the passivity of local communities.The present research, aiming to explain the fundamental capacities of Article7of the Constitution, seeks to redefine the position of councils as a tool for transitioning from a command-based decision-making model to participatory spatial governance.The research method is descriptive-analytical with a legal-developmental approach, conducted through the analysis of upstream documents, enacted laws, and land use planning principles.Research findings indicate that despite the clarity of Article7in recognizing councils as authentic pillars of decision-making and administration of the country's affairs, ordinary legislation, by reducing the status of these grassroots institutions to micro-level service and supervisory areas, has placed spatial management and development guidance under the monopoly of a centralized state bureaucracy.The results suggest that reviving the legislative-decision-making function of Article7through a structural revision in the composition of planning and regional authorities(especially granting an effective and decisive voting right to council representatives in the Provincial Planning and Development Council)will be an inescapable precondition for resolving the conflict between administrative centralization and the general will, achieving functional decentralization,and establishing an optimal model of sustainable and balanced spatial governance. | ||
