| چکیده | ||
| انعقاد قراردادهای صنعت نفت و گاز، امری کاملاً فنی است که با نظام سیاسی، حقوقی و اقتصادی هر کشور صاحب نفت، ارتباطی تنگاتنگ دارد. امروزه، در دنیای تجارت بین‌الملل، انواع قراردادها، نقش اساسی را ایفا می‌کنند. با توجه به نیاز روزافزون صنایع به انرژی نفت وگاز، اهمیت قراردادهای نفت وگاز، دو چندان می‌شود. از طرفی کشف، استخراج، تولید و بهره‌برداری از نفت، مستلزم صرف هزینه‌های هنگفت است. از این رو، آثار حقوقی ناشی از انواع قراردادها و ایجاد انگیزه جهت سرمایه‌گذاری خارجی در صنعت نفت وگاز، اهمیت بسزایی دارد. در این پژوهش، ضمن بررسی اصول و قواعد حقوقی حاکم بر قراردادهای بالادستی صنعت نفت وگاز و با در نظر گرفتن الزامات قانونی و بودجه‌ای و همچنین بررسی انواع قراردادهای بالادستی به این نکته اساسی دست می‌یابیم که علی‌رغم تنوع در قراردادها، همگی از اصول و قواعد حقوقی یکسانی پیروی می‌کنند. این تنوع، برای ایجاد انگیزه و بهره‌وری بیشتر، به منظورجلب سرمایه‌گذاری خارجی، با حفظ مالکیت ملی بر منابع نفت وگاز صورت می‌پذیرد. | ||

| Drawing up oil and gas contacts is a totally technical task which has a close connection to the political, legal and economical regulation of the country with the oil. Now a days existence of various contracts has key roles in the world of international commerce and the importance of the oil and gas contracts is doubled due to the ever increasing needs of industry to oil and gas energy. Besides, discovery, extraction, production and exploitation of oil requires huge expenses. therefore, the regal impacts of different contracts and causing motivation for foreign investigation have critical roles. Examination of the law principles ruling the upstream contracts of oil and gas industry are considered in this study based on the library research method through consideration of the legal obligation , the principles of the annual budget, and various kinds of upstream contracts, we come to this point that in spite of the variation in contracts. they all follow the same legal principles. Such variations are used to cause more motivation and support for foreign investment through maintaining the national ownership of the country over its gas and oil resources. | ||
