چکیده | ||
برخی از زنان به دلیل فقدان رحم، قادر به باروری نمیباشند. خوشبختانه به مدد علمی پزشکی این دسته از اشخاص میتوانند از طریق پیوند رحم باردار شوند. بدین توضیح که طی توافقی دو جانبه، رحم زن اهداکنندهی رحم به متقاضی اهدا پیوند داده میشود. پیوند رحم که از جمله مسائل جدید پزشکی است و در طی دههی اخیر، انجام آن ممکن شده است، با پیوند سایر اعضاء متفاوت است. از جمله آنکه پیوند رحم بر خلاف پیوند سایر اعضای بدن، موقتی بوده و حافط جان انسان نمیباشد. با توجه به مستحدثه بودن عمل پیوند رحم و تفاوت آن با پیوند سایر اعضاء و نقش مهم توافق در آن، ضروریست که خصوصیات و ماهیت حقوقی این قرارداد تبیین گردد. در مقالهی حاضر سعی شده است که خصوصیات و ماهیت حقوقی قرارداد پیوند رحم با مقایسهی عناوین حقوقی چون جعاله، بیع، اعراض، صلح، عقد موجد حق انتفاع، اذن در انتفاع و عاریه تبیین شود و این نتیجه یافت شد که اگرچه لزومی ندارد که فرایند پیوند رحم را به طور کلی در قالب یکی از عقود معین قرارداد داد، لیکن با توجه به ویژگی خاص چنین قراردادی، بهتر است قراداد پیوند رحم در زمرهی عقد هبه قرار گیرد. | ||

Some women are unable to conceive due to lack of uterus. Fortunately, with the help of medical science, these people can get pregnant through a uterine transplant. Explain that under a bilateral agreement, the uterus of the donor woman will be transplanted to the donor. Uterine transplantation, which is one of the new medical issues that has become possible in the last decade, is different from other organ transplants. Among other things, the transplant of the uterus, unlike the transplant of other organs of the body, is temporary and does not protect the human soul. Given the novelty of the uterine transplant procedure and its differences from other organs and the important role of the agreement in it, it is necessary to explain characteristics and the legal nature of this contract. In the present article, an attempt has been made to explain characteristics and the legal nature of a uterine transplant contract by comparing legal topics such as contract of reward, sale, donation, abandonment, transferring, contract consisting right of use, precarious possession and commodation and It was concluded that although it is not necessary to contract the uterine transplant process in the form of a specific contract in general, but given the specific nature of such a contract, it is better to include the uterine transplant contract as a donation contract. . | ||
