| چکیده | ||
| سالانه وقوع حوادث در صنعت ساختمان منجر به خسارتهای مالی، جانی و زیست محیطی زیادی به افراد حقیقی و حقوقی میگردد. علاوه بر خسارتهای مادی، خسارات روحی و معنوی حاصل از آن نیز قابل تامل است. با توجه به این موضوع ضروری است تا با بررسی و تجزیه و تحلیل علل بروز حوادث و اتفاقات، نتایج حاصل جهت ایمن سازی و شناسایی ریسک مورد استفاده قرار گیرند. مواردی از تخریب و آسیبِ ناشی از عدم رعایت ایمنی ساختمان در سالهای اخیر در کشور به گوش خورده است. این حوادث گاهی در اثر نبود مقررات، ابهام و یا حتی انباشت مقررات مشابه و موازی پدید میآید. بدیهی است اولین قدم برای از میان برداشتن ناکارآمدی، شناختن علتهای آن است زیرا توجه به پیشگیری همواره بهتر از درمان است. روش پژوهش در مقالهی حاضر توصیفی-تحلیلی است. بدین معنی که ابتدا توصیف مختصری از قوانین و مقررات مرتبط بیان شده و سپس تحلیل آنها و میزان کارآمدیشان بررسی گردیده است. درنتیجه در این مقاله تلاش شده است با بررسی و نقد قوانین و مقررات حوزۀ ایمنی ساختمان، علل ناکارآمدی آنها تعیین و در پایان راهحل پیشنهادی با هدف جلوگیری از تکرار چنین حوادثی ارائه شده است. مسلماً با رفع نواقص این حوزه، تعیین مقام مسئول و مطالبهی خسارت از او نیز آسانتر میگردد. همچنین پیشنهاد ویژهی این مقاله علاوه بر تصحیح قوانین موازی، تشکیل کارگروه مرتبط با حوزهی بحث است. | ||

| Annual accidents in the construction industry cause a lot of financial, human and environmental losses to individuals and legal entities. In addition to material losses, the resulting mental and spiritual losses are also worth considering. Considering this issue, it is necessary to investigate and analyze the causes of accidents and incidents, and use the results to identify risks. Cases of destruction and damage caused by failure to comply with building safety have been reported in the country in recent years. These accidents sometimes occur due to the lack of regulations, ambiguity, or even the accumulation of similar and parallel regulations. Obviously, the first step to eliminating inefficiency is to identify its causes because attention to prevention is always better than cure. The research method in this article is descriptive-analytical. This means that first a brief description of the relevant laws and regulations is given, and then their analysis and their efficiency are examined. As a result, this article has attempted to examine and criticize the laws and regulations in the field of building safety, determine the causes of their inefficiency, and finally present a proposed solution with the aim of preventing the recurrence of such incidents. Certainly, by eliminating the shortcomings in this area, determining the responsible official and claiming damages from him will become easier. Also, the special suggestion of this article, in addition to correcting parallel laws, is to form a working group related to the area of discussion. | ||
